    These terms and conditions ("Terms") govern the access and use of the Everything in Germany digital platforms and offerings, including everythingingermany.com and related domains, mobile applications, and digital services ("Platforms"), provided by Everything in Germany, operating in India ("Everything in Germany", "we", "us", "our"). The Platforms provide comprehensive information, services, and program packages related to studying, working, and settling in Germany. These Terms apply to all website visitors, users, applicants, and customers ("You", "Your") accessing our Platforms or utilizing any Offerings.

    Definitions

    • "User" or "You" refers to any individual or entity accessing the Platforms or utilizing any Offerings. • "Offerings" encompasses all products, services, content, features, applications, functionalities, and packages available on or through the Platforms. • "Admission Packages" refers to bundled service offerings that provide comprehensive assistance through various stages of the study abroad application process, as specified on the Platforms. • "Services" refers to individual service offerings designed to assist with specific aspects of the study abroad or migration process, as detailed on the Platforms. • "Third Party Services" refers to content, products, services, websites, or applications provided by third parties that may be accessible through our Platforms.

    Platform Usage and Access

    3.1 Permitted Use You are permitted to access and use the Platforms and Offerings solely for lawful personal or educational purposes, in compliance with these Terms and all applicable laws and regulations. 3.2 Prohibited Activities You agree not to engage in any conduct that: • Violates or infringes upon any copyright, trademark, trade secret, patent, or other intellectual property rights of any party; • Breaches any applicable laws, regulations, or rights of any person or entity; • Is harmful, fraudulent, deceptive, threatening, abusive, harassing, defamatory, or libelous; • Impersonates any individual or entity or misrepresents Your affiliation, identity, or authenticity; • Uses unauthorized technology or methods to access, index, frame, or link to the Platforms or Offerings; • Damages, disables, overburdens, or impairs the Platforms or Offerings; • Collects, harvests, or transfers any information from the Platforms including account information; • Attempts to copy, modify, reverse engineer, decompile, or disassemble the Platforms or Offerings. 3.3 User Conduct Standards You agree not to use the Platforms or Offerings to: • Transmit content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of privacy, or otherwise objectionable; • Impersonate any person or entity or falsely state or misrepresent Your affiliation or make statements on behalf of Everything in Germany; • Transmit code, files, or programs designed to interrupt, destroy, or limit functionality of any software or hardware; • Stalk, harass, or promote violence, terrorism, or illegal acts; • Make available material protected by copyright, trademark, or other proprietary rights without express permission; • Submit unsolicited or unauthorized advertising, promotional materials, spam, pyramid schemes, or unwanted solicitation. 3.4 Account Security and User Content If You create or utilize an account through the Platforms, You are responsible for maintaining the confidentiality of Your login credentials and all activities occurring under Your account. You retain ownership of any content You submit, post, display, or make available ("Your Content") and grant us a non-exclusive license to access, use, and reproduce Your Content solely to the extent necessary to provide the Offerings to You. You represent that You have all necessary rights for Your Content and that it complies with our guidelines. 3.5 Privacy and Data Protection Our Privacy Policy outlines how we collect, use, and disclose information about You. By using the Platforms, You consent to the collection, use, and disclosure practices described in our Privacy Policy. 3.6 Third-Party Services and Links The Platforms may enable access to third-party content, products, services, websites, or applications. We do not own, operate, or control these Third-Party Services and are not responsible for their availability, functionality, or accuracy. Your use of Third-Party Services is at Your own risk. 3.7 Intellectual Property Rights All content, materials, features, and functionality available on the Platforms are owned by Everything in Germany and protected by patent, trademark, copyright, trade secret, and other intellectual property laws. You do not acquire any ownership rights in our intellectual property. 3.8 Platform Security We implement technical and organizational measures to secure Your information and use of the Platforms, but we cannot guarantee complete security. You are responsible for maintaining adequate security and backups of Your Content. 3.9 Platform Availability and Modifications We reserve the right to change, suspend, or discontinue any aspect of the Platforms or Offerings at any time without notice or liability. We cannot guarantee the Platforms will be available at all times or in all locations.

    Individual Services

    4.1 Service Description Everything in Germany provides various individual Services to assist with specific aspects of the study abroad process, as detailed on the Platforms. Available Services may include document preparation, university shortlisting, application form assistance, profile evaluations, visa documentation, and related support. Services vary in scope, duration, and pricing as described during the purchase process. All Services are delivered digitally through the Platforms. 4.2 Purchase and Payment You may purchase Services individually by selecting and paying for the desired Service through our checkout process. Payment must be made upfront in full using accepted payment methods including credit card, debit card, net banking, UPI, or other methods shown. All charges will be disclosed prior to purchase completion. Prices may exclude taxes and fees which will be added during checkout. 4.3 Service Delivery Purchased Services will be initiated following payment confirmation and delivered within the timeline specified during checkout, typically within 3-15 business days. We will notify You by email upon completion and delivery. Services are delivered digitally through the Platforms or Your account. You are responsible for retaining proof of purchase. 4.4 License and Usage Rights Any Services or deliverables purchased are for Your personal, noncommercial use only. You receive a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use such deliverables for that purpose only. We retain all copyright, intellectual property, and ownership rights. 4.5 Preference Submission Requirements After placing an order for individual services, students will receive an email with a link to submit preferences. Preferences must be submitted within 7 days of order placement unless a written extension is granted by our team. Failure to submit within the timeframe will result in the order being marked as completed with no refund eligibility. 4.6 Student Review Process Several services include a 'Student Review' phase. Upon reaching this phase, an email will be sent for review. A response is required within 48 hours. If no response is received: • A first reminder will be sent • If still no response, a final reminder will be issued 24 hours later • If no response within 24 hours of the final reminder, the order will be closed and the final draft delivered • No changes can be accommodated after order completion; no refunds will be provided 4.7 Review Limitations For services involving student review, a maximum of two review rounds will be conducted—one major and one minor review. Additional review requests beyond this limit cannot be accommodated. Our team follows established best practices based on extensive experience. No refunds will be provided for requests exceeding the review limitation. 4.8 Refund Policy for Individual Services Refund requests made within 24 hours of order placement may be eligible for a 50% refund, provided our team has not commenced work on the order (You will receive email notification upon commencement). Once work has begun on the order, refund requests will not be entertained. No refunds will be processed after the review phase has been completed or the service has been delivered. 4.9 Service Disclaimers We make no promises, representations, warranties, or guarantees regarding the Platforms, Offerings, or Services, whether express, implied, statutory, or otherwise, including regarding merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, usefulness, reliability, availability, accessibility, timeliness, security, absence of viruses or harmful code, quality, suitability, privacy, or rights. 4.10 Your Obligations You represent and warrant that: (i) You have all necessary consents and rights to provide information used in purchasing Services; (ii) Your purchase complies with all applicable laws and regulations; (iii) You will use Services only for lawful purposes as permitted; (iv) You will not attempt to obtain Services through fraudulent or improper means; and (v) all information supplied is true, accurate, and complete.

    Admission Packages

    5.1 Package Description Everything in Germany offers comprehensive Admission Packages designed to guide and assist users through the complete study abroad application process, as detailed on the Platforms. Packages consist of combinations of Services, resources, information, tools, and ongoing support. Available Packages vary in scope, offerings, duration, and pricing as displayed. All Package components are delivered digitally through the Platforms. 5.2 Package Purchase Process You may purchase any Admission Package listed on the Platforms by selecting Your preferred Package and completing the checkout process. Certain Packages may require additional information or instructions during checkout. All descriptions, prices, components, and instructions are as shown for each Package at the time of purchase. 5.3 Package Pricing and Payment Pricing and payment terms for Admission Packages are provided during checkout. All charges will be disclosed prior to purchase completion. Payment must be made upfront and in full using accepted payment methods to receive the Package. Valid payment methods include credit card, debit card, net banking, UPI, or other methods displayed. You consent to receive digital invoices through the Platforms or the email associated with Your purchase. 5.4 Taxes and Additional Fees Published prices for Packages exclude taxes and fees dependent on billing or shipping address. All applicable taxes and fees will be added and disclosed during the checkout process. 5.5 Package Delivery Delivery of Services for Purchased Packages will commence within 2-3 business days of Your enrollment. Delivery includes granting access to the Student Dashboard and other components digitally through Your account. Additional activities related to Your application process will proceed following Your onboarding session. 5.6 Package License Any Packages or resulting deliverables purchased are for personal, noncommercial use only. You are granted a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use deliverables solely as part of the Package. We retain all copyright, intellectual property, and ownership rights. 5.7 General Refund Policy for Packages Refund requests must be initiated within 30 days of enrollment to any package. The following deductions will apply to refund amounts: • Payment Gateway and Student Dashboard Fees: ₹10,000 (charged at enrollment) • Fees for any Services already utilized, calculated based on prices on our Services Page After the 30-day period, no refunds will be processed for Value and Standard Packages, except if management grants up to a 30% refund in special circumstances based on case genuineness and at its sole discretion. 5.8 Premium Package Refund Terms For the Premium Package, if the total amount has been fully paid, we will initiate a refund of ₹50,000 provided the following conditions are met: 5.8.1 University Applications Students must be willing to apply to all universities and courses shortlisted by their counsellor based on profile and preferences. Failure to agree to apply to shortlisted courses voids the refund guarantee. 5.8.2 Timely Cooperation Requirements Students must complete the following within specified timeframes: • Upload all required documents within 3 days of counsellor request • Submit preferences/requirements for all orders within 2 days of counsellor request • Finalize shortlisted university options within 5 days of receiving first draft • Finalize document orders within 7 days of first draft delivery • Provide all necessary application information within 3 days of counsellor request • Complete student reviews within 48 hours of receiving review email • Make payment of application fees within 2 days of counsellor request • Courier hard copy documents to universities within 2 days of counsellor request Any delays resulting in missed application timelines or submissions will forfeit the refund guarantee. 5.8.3 Refund Issuance Conditions If all conditions are met and admission is not secured after two intakes, a refund of ₹50,000 will be issued. Refunds will be processed within 7 working days of the request made after two admission cycles with rejections. Refunds will only be issued after all application results are announced. Any pending results will delay refund issuance until final outcomes are received. 5.9 Package Guarantees We guarantee all components of Purchased Packages will meet the description and scope defined on the Platforms at the time of transaction. If You reasonably believe a Package differs materially, please contact us within 30 days to discuss potential remedies at our reasonable discretion. 5.10 Package Disclaimers Except for the guarantees in Section 5.9, we make no promises, representations, warranties, or guarantees regarding the Platforms, Offerings, or Packages, whether express, implied, statutory, or otherwise. 5.11 Your Package Representations You represent and warrant that: (i) You have necessary consents and rights to provide information used in purchasing Packages; (ii) Your purchase complies with applicable laws; (iii) You will use Packages only for lawful purposes; (iv) You will not attempt to improperly obtain any Package component; and (v) all information provided is true, accurate, and complete.

    German Student Visa Application Services

    6.1 Non-Refundable Service Policy All visa service packages (Essential, Premium, Complete) are non-refundable, regardless of visa outcome. Visa approval or rejection is determined by the applicant's individual profile, documentation, and personal interview, and lies solely within the authority of German immigration authorities. Non-refundable situations include but are not limited to: • Visa rejection by the German Embassy or Consulate • Incomplete or incorrect documents provided by the applicant • Failure to attend the VFS appointment or visa interview • Changes in student plans or withdrawal from the process after purchase • Delays caused by applicant unresponsiveness or late document submission 6.2 Applicant Responsibilities Applicants are responsible for: • Providing accurate and complete information throughout the process • Attending all required appointments including VFS appointment and visa interview • Ensuring all documents are valid, authentic, and submitted on time • Maintaining timely coordination with the assigned counsellor to avoid delays • Complying with all requirements and instructions provided by the counsellor 6.3 Service Scope Limitations Our services are limited to guidance, form filling assistance, and documentation support. We do not influence embassy decisions or guarantee visa approval. Visa decisions are made solely by German authorities based on their assessment of the application and applicant. 6.4 Processing Timelines Application assistance typically requires 3-5 business days once all required documents are ready. Embassy processing may take 6-8 weeks or longer. Delays in embassy processing are not within our control and do not constitute grounds for refund. 6.5 Partial Service Support Support is available for applicants who have already completed part of the visa process independently. Service charges will apply based on the remaining steps requiring assistance. 6.6 Support Availability Support is available until the VFS appointment date as per the plan purchased. Post-appointment support may be available subject to additional charges. 6.7 Data Protection and Confidentiality All personal data provided for visa application assistance is handled confidentially and used solely for the purpose of visa application support in accordance with our Privacy Policy.

    General Disclaimers

    7.1 Platform Disclaimers We make no promises, representations, warranties, or guarantees regarding the Platforms or Offerings, whether express, implied, statutory, or otherwise, including regarding merchantability, fitness for a particular purpose, suitability, accuracy, completeness, effectiveness, reliability, timeliness, adequacy, usefulness, availability, accessibility, quality, non-infringement, absence of errors, viruses or harmful code, negligence, title, that the Platforms or Offerings will meet Your requirements or expectations, will be available at any particular time or location, uninterrupted or secure, free of inaccuracies or errors, or without loss or corruption of data, free of viruses or harmful code, that any defects will be corrected, or that the Platforms or Offerings are free of viruses or errors that could cause damage. We disclaim any obligations or warranties not expressly stated herein. 7.2 Third-Party Service Disclaimers We make no guarantees or warranties regarding any Third-Party Services. Your use of Third-Party Services is solely at Your own risk. 7.3 No Additional Representations No advice, statement, or information provided by us, our representatives, directors, affiliates, employees, agents, suppliers, or licensors, whether oral or written, shall create any representation, warranty, collateral contract, assurance, or guarantee beyond what is expressly stated in these Terms.

    Limitation of Liability

    8.1 Exclusion of Indirect Damages Under no circumstances shall Everything in Germany, nor our licensors, directors, officers, agents, or employees, be liable for any indirect, incidental, special, consequential, or exemplary damages arising from or in connection with Your access or use of, or inability to access or use, the Platforms or Offerings, including damages for lost profits, revenues, business opportunities, goodwill, anticipated savings, business interruption, loss of data, discrepancies in information, delays, security breaches, viruses, harmful code, errors, inaccuracies or misinformation, even if foreseeable or made known to us. 8.2 Maximum Liability Cap To the maximum extent permitted by law, under no circumstances shall we, nor our licensors, directors, officers, agents, employees, or suppliers, be liable to You for more than the amount You paid to us under these Terms in the prior six-month period. 8.3 Essential Purpose These limitations shall apply notwithstanding any failure of essential purpose or inadequacy of any remedy provided herein or available at law or equity. We would not be able to provide the Platforms or Offerings without these limitations.

    Indemnification

    You agree to fully indemnify, defend, and hold harmless Everything in Germany and our officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, expenses, fees (including reasonable attorneys' fees and costs) that arise from or relate to: • Your access or use of the Platforms, Offerings, or Services • Any User Content provided by You • Any misrepresentations made by You • Your violation of any of these Terms • Your violation of any applicable laws, rules, regulations, or rights of another • Legal actions brought by You against us that are unsuccessful or frivolous We reserve the right, at Your expense, to control the defense and settlement of any such claim.

    Dispute Resolution and Arbitration

    10.1 Informal Resolution In the event any dispute or difference arises between You and Everything in Germany out of or in relation to or in connection with these Terms, the parties agree to first attempt to resolve such disputes informally through good-faith negotiations and mutual agreement. 10.2 Binding Arbitration If such informal attempts at resolution fail, the dispute shall be referred and resolved by binding arbitration under the laws of India before a sole arbitrator appointed by Everything in Germany. Arbitration proceedings shall be conducted in English in accordance with the Arbitration and Conciliation Act 1996 and any amendments thereto. The arbitrator's award shall be final and binding on both parties. 10.3 Jurisdiction The courts of India shall have exclusive jurisdiction over any matters arising out of or relating to these Terms that are not subject to arbitration.

    Student Data Usage for Marketing

    11.1 Marketing Content Usage We may use student testimonials, reaction videos, or other content voluntarily provided to us for marketing purposes on our social media pages, website, or other marketing channels. 11.2 Admission Success Publishing We may publish student admission information, including admission letters, on social media and marketing materials to highlight student successes and program effectiveness. No personal contact information such as phone numbers or email addresses will be shared without explicit prior written consent. 11.3 Content Removal Requests Students may request removal of any previously published content including their data or admissions information by contacting us. We will take down such content within 48 hours of receiving a verified request. 11.4 Contact Information Protection We will not publish any student personal contact information such as phone numbers or email addresses without prior written consent obtained separately from these Terms. 11.5 Student Consent By using our Services and Platforms, students acknowledge and consent to the use of their voluntary testimonials, reaction videos, and admission successes for marketing purposes in compliance with the above policies and applicable data protection laws.

    Information Sharing with Partners

    12.1 Partner Network Everything in Germany may share your personal information and application details with selected third-party partners for facilitating services related to studying abroad. These partners assist with financial services, travel arrangements, accommodation, or other relevant services. Information will only be shared with partners directly involved in your study application and travel process. 12.2 Partner Categories Partners may include: • Banks and financial institutions for education loans • Blocked account providers for German student visa requirements • Forex services for remittances and currency exchange • Travel agencies for flight booking • Accommodation providers • Insurance providers for health and travel insurance • Visa processing centers and related service providers • Any other contracted service partner relevant to the study abroad process 12.3 Shared Information Information shared may include: • Name and contact details • Educational background and application status • Financial information necessary for loan or blocked account services • Travel and accommodation preferences • Other relevant information necessary for service facilitation (upon your consent) 12.4 Consent to Sharing By using our Services, You agree to your data being shared with our trusted partners for the sole purpose of facilitating and streamlining the study abroad process through ancillary services. Partners are not authorized to use your data for any other purpose or share information with other third parties. 12.5 Partner Confidentiality Requirements Our partners are contractually required to maintain strict confidentiality of any student information shared with them. Partners may only use student information for the sole purpose of providing the relevant service to facilitate the study application process. Partners are prohibited from: • Sharing or disclosing student information to any other third party • Using the data for any purpose other than providing the contracted service • Retaining information after fulfillment of the service Any partner misuse of student data is subject to legal action from Everything in Germany or the student for violation of data protections. Students may request that we do not share information with any partner demonstrating misuse of data or noncompliance with confidentiality requirements. 12.6 Opt-Out Rights You may request that we do not share your information with select partners by contacting us. However, opting out of sharing with partners involved in required services (such as blocked account providers or visa processing centers) may impact our ability to provide comprehensive assistance for your study abroad journey.

    General Provisions

    13.1 Modification of Terms We may modify, update, suspend, discontinue, or restrict access to all or any part of the Platforms, Offerings, or Terms at any time and for any reason, without notice or liability. Any changes will be effective upon posting on the Platforms. Your continued use after changes constitutes acceptance of the modified Terms. You should review the Terms periodically for updates. 13.2 Entire Agreement These Terms constitute the entire agreement between You and Everything in Germany with respect to access and use of the Platforms and Offerings and supersede any prior agreements, understandings, or communications. 13.3 Severability If any provision of these Terms is deemed unlawful, void, or unenforceable for any reason, that provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect. 13.4 Assignment You may not assign or transfer these Terms or any rights or obligations herein without our prior written consent. Everything in Germany may freely assign these Terms, including in connection with a merger, acquisition, or sale of assets. 13.5 Survival Any provisions that by their nature should survive termination, including limitations of liability, indemnification, general disclaimers, arbitration provisions, and payment obligations, shall survive termination of these Terms. 13.6 No Waivers Any failure or delay by us to enforce any provision of these Terms shall not constitute a waiver of that provision or of any other provision. Partial or single exercise of a right does not preclude further exercise of that right or any other right. 13.7 Notices Any notices relating to these Terms from You must be provided via email to hello@everythingingermany.com. We may provide notices to You via email, the Platforms, or other reasonable means. 13.8 Third-Party Rights Other than as expressly provided herein, no third party shall have any rights or remedies under these Terms. 13.9 Force Majeure Everything in Germany shall not be liable for any failure to perform its obligations hereunder if such failure results from circumstances beyond its reasonable control, including without limitation, acts of God, natural disasters, war, riots, government intervention, embargoes, strikes, labor disputes, network infrastructure failures, power outages, pandemics, or shortages of adequate power, fuel, materials, or transportation facilities.
